TERMS AND CONDITIONS

These TERMS AND CONDITIONS OF TULIKA PREMIUM form an integral part of the agreement (contract) entered into between OÜ Tulika Premium and the Client.

1. DEFINITIONS  

1.1 Transport Service Provider: OÜ Tulika Premium, registry code 10459113, address Tihase 34, Tallinn City, Harjumaa county, 10619. 1.2 Client: the person who enters into an agreement with the Transport Service Provider to use the Service and who is obliged to pay the Transport Service Provider for the Service. 1.3 Passenger: a natural person who uses the Service under the conditions agreed between the Client and the Transport Service Provider. The Client and the Passenger do not have to be the same person. 1.4 Prestige Car: a vehicle according to the description given on the website www.tulikapremium.ee. 1.5. Service: the transport of a Passenger/Passengers in a Prestige Car/Cars under the conditions agreed between the Transport Service Provider and the Client.  

2. GENERAL TERMS AND CONDITIONS  

2.1 The Service shall be provided using a Prestige Car. 2.2 The service can be ordered: 2.2.1 online at www.tulikapremium.ee/tellimine at least 24 hours prior to the requested start of the provision of the Service; 2.2.2 by sending an email to info@tulikapremium.ee at least 24 hours prior to the requested start of the provision of the Service. 2.3 If the Service is ordered by email, the Client shall submit to the Transport Service Provider at least the following data: travel date(s), departure and destination points and times, the name(s) of the Passenger(s), the type of Prestige Car based on the description given at www.tulikapremium.ee, and the details of the Client. If the Service is ordered online, the Client shall fill in the required form. 2.4 If the Service is ordered by email, the Client shall confirm, by paying for the Service, that the Client has read and accepted the TERMS AND CONDITIONS OF TULIKA PREMIUM. If the Service is ordered online at www.tulikapremium.ee/tellimine, the Client shall provide this confirmation online at www.tulikapremium.ee/tellimine. 2.5 The order shall be considered confirmed by the Transport Service Provider provided that the Client has received the Transport Service Provider’s confirmation at the Client’s email address.  

3. PAYMENT CONDITIONS  

3.1. The Client shall pay for the Service 100% in advance. If the Service is ordered by email, the Client shall pay for the Service in advance on the basis of an invoice submitted by the Transport Service Provider and by the date indicated therein. If the Service is ordered online, the Client shall pay for the Service in advance through online banking upon placing the order. 3.2 The Transport Service Provider shall have the right to refuse to fulfil the order if the Client has not paid fully for the Service in advance by the due date.  

4. FULFILMENT OF ORDER AND LIABILITY  

4.1 The Client and/or Passenger shall have the right to use the Service only in accordance with the conditions agreed between the Client and the Transport Service Provider. 4.2 Before the start of the transport, the Transport Service Provider shall have the right to request from the Passenger(s) an identification document and/or the voucher confirming the order. 4.3 The Transport Service Provider will not reimburse to the Client the payment made for the Service if the transport of the Passenger(s) cannot be carried out because the order placed by the Client contains inaccuracies. 4.4 The Transport Service Provider shall not be liable for any changes to the route and/or date and/or time specified in the order if the changes have resulted from actions of the Client, the Passenger(s) or third parties, or from force majeure.  

5. CHANGING OF ORDERS  

5.1 The Client shall have the right to change a placed order by sending an email to info@tulikapremium.ee at least 24 (twenty-four) hours prior to the initially requested start of the fulfilment of the order. 5.2 If a change to the order results in a higher price for the Service, the Client shall pay the difference 100% in advance by the date indicated in the invoice submitted by the Transport Service Provider. 5.3 If a change to the order results in a lower price for the Service, the Transport Service Provider shall pay the difference to the current account of the Client within 3 (three) working days from the change to the order. 5.4 Any changes to the order shall be considered confirmed by the Transport Service Provider provided that the Client has received the Transport Service Provider’s confirmation at the Client’s email address. 5.5 The Transport Service Provider shall have the right to refuse to change the order.  

6. CANCELLATION OF ORDERS  

6.1 The Client shall have the right to cancel a placed order at least 24 (twenty-four) hours prior to the requested start of the fulfilment of the order by sending an email to info@tulikapremium.ee. 6.2 If the Client cancels the order less than 24 (twenty-four) hours prior to the requested start of the fulfilment of the order, the payment made for the Service shall not be reimbursed. 6.3 If the Client cancels the order at least 24 (twenty-four) hours prior to the requested start of the fulfilment of the order, 50% of the payment made for the Service shall be reimbursed to the Client. 6.4 If the Client cancels the order at least 48 (forty-eight) hours prior to the requested start of the fulfilment of the order, 100% of the payment made for the Service shall be reimbursed to the Client. 6.5 The order shall be considered cancelled provided that the Client has received the Transport Service Provider’s confirmation at the Client’s email address.  

7. RIGHTS OF TRANSPORT SERVICE PROVIDER  

7.1 The Transport Service Provider shall have the right to refuse to provide the Service if the Passenger(s): 7.1.1 is/are intoxicated; 7.1.2 pose(s) a threat to the safety of the driver; 7.1.3 impair(s) in any other manner the provision of the Service, or safety. 7.2 If any of the Passengers has misunderstandings with the Estonian authorities due to invalid travel documents, illegal goods etc., the Transport Service Provider shall have the right to end the provision of the Service. 7.3 If the Transport Service Provider refuses to provide the Service or ends the provision of the Service for the reasons specified in points 7.1 and/or 7.2, the payment made for the Service shall not be reimbursed to the Client.  

8. CONFIDENTIALITY AND PRIVACY  

8.1 The Transport Service Provider shall not disclose any personal data about the Client or the Passenger(s) provided to it by the Client unless these persons have given permission to disclose such data or unless the right to disclose such data is provided by law.  

9. FINAL PROVISIONS  

9.1 The Transport Service Provider shall have the right to change and/or supplement the price list and/or the TERMS AND CONDITIONS OF TULIKA PREMIUM unilaterally and without notice. The price list and/or the TERMS AND CONDITIONS OF TULIKA PREMIUM shall be considered changed upon their publication on the website www.tulikapremium.ee.
